General Terms and Conditions of Use
The purpose of these general terms and conditions of use (referred to as “GCU”) is to provide a legal framework for the terms and conditions for making the Site available (i.e., all the Sites in the www.danitis.com and jobs.danitis.com domain as defined in Article 1 below) and its services and to define the conditions for access and use of the services by persons consulting the Site and/or registered as members on the Site “the Users”.
Users may be candidates, i.e. people looking for a job and who publish their profile on the Site, or recruiters, i.e. people offering job offers.
These T&Cs are available on the Site under the heading “T&Cs”.
Any consultation, use of the Site or registration on the Site implies acceptance without any reservation or restriction of these T&Cs by the User.
In the event of non-acceptance of these T&Cs, the User must waive access to the Site and the services it offers.
DANITIS reserves the right to unilaterally modify the content of these T&Cs at any time.
Article 1: Access to the site
The Sites in the www.danitis.com domain provide the User with access to the following services (together, the “Site”):
- Free job search by any natural person on jobs.danitis.com
- Free consultation of all content posted online at www.danitis.com
Article 2: Use of the Site and its services
The Site is accessible free of charge in any place to any User with Internet access. All costs incurred by the User to access the service (hardware, software, Internet connection, etc.) are at his expense.
The non-member User does not have access to the reserved services. To be a member, the User must register for the reserved services by completing the registration form. When registering on the Site via the registration form, each User expressly accepts these T&C by checking the box preceding the following text “I accept the conditions of use”.
By agreeing to register for the reserved services, the Member User undertakes to provide sincere and accurate information concerning his civil status, his contact details, in particular his e-mail address and his mobile phone number.
To access the reserved services, the Member User must then identify himself/herself using his/her username and password, which will be sent to him/her by email after registration. Any User who is a regularly registered member may also request to unsubscribe by sending an email to firstname.lastname@example.org This will be effective within one month.
The site allows the:
- Candidate users to consult job offers and publish content concerning their professional background (CV, affinities, remuneration, etc.), and on sales and management professions.
- Other users to consult all the content on the Sites.
Article 3: Intellectual Property
The trademarks, logos, signs, as well as all the contents of the Site (texts, information, data, images, sound…) are protected by the Intellectual Property Code and more particularly by copyright.
The DANITIS brand is a French brand registered with the INPI by DANITIS. Any representation and/or reproduction and/or partial or total exploitation of these trademarks without the prior authorization of DANITIS, of any nature whatsoever, is totally prohibited.
The contents of the Site are the property of DANITIS or its partners and/or protected by intellectual property rights. The User is authorized to use the contents of the Site for personal and private purposes only. Any other use of the contents, in particular by making the contents available to third parties on any medium whatsoever, is strictly prohibited.
Article 4: Responsibilities
The information published on the www.danitis.com and jobs.danitis.com domain Sites is deemed reliable, but the Site does not guarantee that it is free of defects, errors or omissions. The information provided is presented for information purposes only and in general without contractual value. Similarly, the Site cannot be held responsible for the use and interpretation of the information contained on the Site.
DANITIS may under no circumstances be held liable for the consequences of any false declarations that the User may have made concerning his diploma, skills or professional experience in order to obtain the position, in particular through the information contained in his Curriculum Vitae and collected as part of the pre-qualification of applications.
DANITIS cannot be held responsible for any viruses that may infect the User’s computer or any computer equipment following use, access or downloading from the Site.
Hypertext links may be present on the Site. The User is informed that by clicking on these links, he/she will leave the Site. DANITIS has no control over the web pages to which these links lead and will under no circumstances be responsible for their content.
Article 5: No guarantee
The service of the Site, in particular the posting of advertisements, constitutes an obligation of means within the meaning of the provisions of the French Civil Code. DANITIS does not expressly or implicitly guarantee the transformation of applications into recruitment. DANITIS does not in any way guarantee the suitability and integrity of the candidates presented to the recruiter, whose evaluation responsibility is entirely his. The recruiter undertakes to take charge of verifying the diplomas and employment certificates of the candidate he wishes to recruit.
Article 6: Personal data
DANITIS undertakes to comply with the legislation in force on the protection of personal data, in particular Law No. 78-17 of 6 January 1978 on data processing, data files and individual liberties and European Regulation (EU) 2016/679 of 25 April 2016 of the Parliament and the Council on the protection of individuals with regard to the processing of personal data.
Article 7 : Cookies
The User is informed that during his visits to the Site, a cookie may be automatically installed on his browser software.
Cookies are small files that are temporarily stored on the User’s computer hard drive by your browser and are necessary for the use of the www.danitis.com domain Sites. Cookies do not contain personal information and cannot be used to identify anyone. A cookie contains a unique identifier, generated randomly and therefore anonymous. Some cookies expire at the end of the User’s visit, others will remain.
The information contained in cookies is used to improve the user experience on the www.danitis.com domain sites.
By browsing the Site, the User accepts them. In the absence of acceptance, the User is informed that certain features or pages may be refused. The User may disable these cookies by using the settings in his browser software.
Article 8: Applicable law and competent jurisdiction
French law applies to this contract. In the absence of an amicable resolution of a dispute arising between the parties, the French courts shall have sole jurisdiction to hear it.
